Terms of Service

These Terms govern your access to and use of ApiNxt (the “Service”), operated by Avenux Techspire (“we”, “our”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility & account

You must be at least 16 years old and capable of forming a binding contract to use ApiNxt. You are responsible for everything that happens under your account, including the accuracy of the information you provide and the security of your password.

You agree to:

  • provide accurate and complete information when registering;
  • keep your password and any access tokens confidential;
  • notify us promptly of any unauthorized use of your account;
  • not share your account with anyone else.

2. Acceptable use

You may not use ApiNxt to:

  • violate any law or third-party right;
  • attack, scan, probe, or test the security of any system you do not own or have explicit permission to test;
  • send unsolicited bulk requests or otherwise abuse rate limits;
  • upload or transmit malware, ransomware, or other harmful code;
  • reverse-engineer, decompile, or attempt to extract source code from the Service;
  • resell, sublicense, or otherwise commercialize the Service without our written consent.

We may suspend or terminate accounts that violate these rules, with or without notice, depending on severity.

3. Your content

You retain all rights to the collections, requests, environments, scripts, and other content you upload to ApiNxt (your “Content”). You grant us a limited license to host, store, and process your Content solely to operate the Service.

You are responsible for ensuring you have the right to upload your Content and that it does not infringe anyone else’s rights.

4. Service availability

We work hard to keep the Service available, but we do not guarantee uninterrupted access. We may perform scheduled maintenance, deploy updates, or experience unexpected outages. Where reasonable, we will give advance notice of planned downtime.

5. Plans, billing & refunds

Some features require a paid plan. Subscriptions renew automatically until cancelled. You may cancel any time from your account settings; cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law.

6. Intellectual property

ApiNxt, the Service, and all related logos, trademarks, and underlying technology are owned by Avenux Techspire and protected by intellectual property laws. These Terms do not grant you any rights to our brand or technology beyond what is needed to use the Service.

7. Termination

You may delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if continuing to provide the Service to you would expose us or other users to harm. On termination we will delete your data according to our Privacy Policy.

8. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the fullest extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly.

Our total aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the event giving rise to the liability or (b) USD 100.

10. Governing law

These Terms are governed by the laws of the jurisdiction in which Avenux Techspire is registered, without regard to its conflict-of-laws principles. Any dispute will be resolved in the competent courts of that jurisdiction.

11. Changes

We may update these Terms from time to time. Material changes will be announced at least 30 days before they take effect. Continued use of the Service after changes take effect means you accept the updated Terms.
